Priority Clause
In the event of any discrepancies between the provisions in the downloadable PDF registration forms or older printed versions of this website and the General Terms and Conditions published online here, the most current online version on this website shall legally take precedence.
Liability
*Health & Physical Fitness: Our courses are conducted with reasonable skill and care. However, participants are solely responsible for determining whether a class is compatible with their physical and psychological health. If you have any medical concerns or doubts, you must consult a doctor before participating.
*Limitation of Liability (for participants subject to German/European jurisdiction):
(1) INTEGRALARTS shall be liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health in accordance with statutory provisions.
(2) In the event of a slightly negligent breach of essential contractual obligations (so-called Kardinalpflichten – i.e., obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the participant regularly relies), the liability of INTEGRALARTS shall be limited in amount to the damage that was foreseeable and typical for the contract at the time of conclusion.
(3) In the event of a slightly negligent breach of other non-essential obligations (e.g., simple secondary duties, leaving items behind in the premises), liability for damage to property and financial loss is excluded.
*Liability Waiver & Assumption of Risk (for participants subject to US jurisdiction):
To the maximum extent permitted by applicable law, you hereby explicitly waive, release, and forever discharge INTEGRALARTS and its owner from any and all claims arising out of ordinary negligence. You voluntarily assume all inherent risks of physical injury associated with instruction in any and all forms of physical movement, dance, yoga, somatic practices, breathwork, meditation, and wellness exercises offered by INTEGRALARTS, whether delivered via online live stream, digital recording, or in-person sessions.
*Online Class Terms & Responsibilities:
You acknowledge that these courses are conducted online via live stream (e.g., Zoom). The instructor cannot physically monitor your training space, your equipment, or your full physical posture. You assume full responsibility for creating a safe, hazard-free, and unobstructed environment for your practice in your own premises. During the online transmission, it is your sole responsibility to mindfully monitor your own physical limits and to only perform exercises to an extent that is pain-free.
Private Sessions
* Cancellation Deadline: Cancellations must be submitted during INTEGRALARTS business hours (Monday 7:00 a.m. to Friday 12:00 p.m.) and at least 48 hours prior to the appointment. For appointments on Mondays or Tuesdays, cancellations must be submitted no later than Friday before 12:00 p.m. Late cancellations will be billed at the full rate.
* Rescheduling Requirements: To avoid losing the session, a replacement appointment within the booked course period must be mutually agreed upon by both parties at the time of cancellation. If a suitable new single appointment cannot be found, the missed session (50 minutes) may alternatively be split across two already scheduled appointments by extending each of them to 75 minutes.
Hatha Vinyasa Yoga Group Courses
*Basic Online Package: This fixed 12-week course includes one scheduled class per week. Participants may make up a missed class on another scheduled course day (maximum of 2 makeup sessions per 12-week course). To qualify for a makeup session, you must notify INTEGRALARTS of your absence and request your replacement date at least 6 hours before the class starts to allow for effective planning. If a class is canceled on short notice by INTEGRALARTS (due to instructor illness, seminars, or unforeseen circumstances), a makeup class will be provided on an alternative day within the 12-week period.
*Unlimited Online Package: This fixed 12-week course grants access to 1 to 3 classes per week (typically 3 classes per week). The exact number of available weekly classes may vary due to holidays, seminars, or unforeseen short-term cancellations and illnesses that may impact specific class days during the 12-week term.
Class Cancellations & Absences
* If you do not attend a registered course, we will charge 100% of the course fee. In cases of exceptional hardship, alternative arrangements may be agreed upon in writing by both parties.
* Studio Cancellations & Substitutions: INTEGRALARTS reserves the right to provide a qualified substitute instructor if the scheduled teacher is unavailable. In the event of a sudden instructor illness where no substitute is available, the studio reserves the right to reschedule the class to a later date. INTEGRALARTS may also cancel a seminar at any time for other important reasons (e.g., low participant numbers). If a session is canceled entirely by the studio and cannot be rescheduled, any fees already paid for that session will be refunded in full. Further claims for damages are excluded, unless they are based on intent or gross negligence by INTEGRALARTS.
Booking & Administration
* All correspondence regarding registration, questions, or change requests must be received and mutually confirmed within the specified deadlines. Requests or changes that have not been finalized by the deadline cannot be accommodated due to organizational reasons, and subsequent modifications will require a separate, individual agreement.
* The course booking is confirmed with the completed registration form and with the payment of the course fee.
*Timetable & Website Changes: All information listed on our website and timetables is subject to change. INTEGRALARTS reserves the right to modify schedules, instructors, and pricing at any time without prior notice. Price changes will not affect courses or seminars that have already been booked and paid for.
*Governing Law and Jurisdiction:
These Terms and Conditions, and any disputes arising out of or in connection with our courses, shall be governed exclusively by the laws of Germany. Any legal action, suit, or proceeding arising under or in connection with these terms shall be brought exclusively in the competent courts of Augsburg, Germany, unless the participant is a private consumer within the EU, for whom mandatory statutory places of jurisdiction apply. You hereby waive any right to bring claims in any other jurisdiction or forum. Participants outside the European Union expressly agree to Augsburg, Germany, as the exclusive and mandatory venue (exclusive and mandatory forum selection), waiving any rights to bring claims in any other jurisdiction. If a court of competent jurisdiction rules that a dispute must be heard outside of Germany, you agree that this agreement’s liability waivers and assumptions of risk shall still apply to the maximum extent permitted by that court’s local law.
The European Commission provides a platform for Online Dispute Resolution (ODR), which can be found at europa.eu. INTEGRALARTS is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
* By registering for the course, participants agree to the studio conditions, conditions of participation, and general terms and conditions.
